Why the US Supreme Court decision on On Obama Care is Good

I’m thrilled that the US Supreme Court upheld Obama Care, especially the mandate that everyone buys health insurance or pays a tax penalty. Senator Marco Rubio stated on CNN that this is just another tax increase and that the Supreme Court even called it a tax increase. He warned it will get a lot of people in trouble with the IRS. That’s good because it will decrease the cost of my health insurance. I’m tired of paying for my health insurance and seeing so many people around me get treatment for free at the expense of the people who are paying for health insurance.

I personally know many people who simply don’t buy health insurance because they can’t afford it after paying for luxury cars, expensive clothes and expensive dinners. They think that they are in good health and prefer to spend their money on luxuries. When they unexpectedly get sick, they get free healthcare by going to the hospital emergency room.

As an attorney, I tend to find out about people without health insurance more often because people don’t generally advertise that they did not buy health insurance. In fact, I know people who didn’t even tell their wives that they aren’t paying for health insurance. There are an astounding number of people that do not have health insurance. The cost of treating everyone who does not pay for health insurance is increasing the cost of health insurance for everyone else.

Every year, I get a letter from my health insurance company advising of a 17% increase. At this rate, I would have to drop out of health coverage myself. In just a few years, my health insurance premium went from $225 per month to almost $1,500 per month.

For doctors, this is the best thing that could have happened. The health insurance system has been rapidly moving from a crisis to collapse. The only other alternative is socialized medicine. Obama healthcare will eliminate the need to move to socialized medicine.

Tennessee Walking Horses Should Be Illegal

ABC News Nightline aired undercover video shot by Humane Society of the United States investigators showing horribly disturbing scenes of horses allegedly tortured under the supervision of a well known Tennessee Walking Horse trainer, Jackie McConnell of Collierville, Tennessee.

I wish I could torture Tennessee Walking Horse trainer, Jackie McConnell or just put him out of his misery and shoot him. Unfortunately, it’s illegal but if I was dictator I would do it myself. I would also ban the entire industry of Tennessee Walking Horses.

Why Obama Care is Needed

President Obama’s health care reform, the Affordable Care Act (Obama Care) is needed to avoid an implosion of the healthcare system but it can be avoided with one simple change.  How?  If you don’t buy health insurance, you don’t get medical treatment.

It should be noted that there is nothing new about requiring everyone to purchase insurance.  If you want to drive a car, you have to buy car insurance. In fact, there is nothing new about requiring everyone to purchase medical insurance.  It’s being done right now in every state which has No-Fault insurance.  In a No-Fault state, every car owner is required to buy No-Fault medical insurance. It should also be noted that Obama Care does not require everyone to buy insurance. It does not require poor people to buy insurance and only requires people to buy insurance if they have sufficient funds to do so.

What’s wrong with not requiring everyone to buy health insurance (the GOP position)?  The answer is very simple and is the reason why the healthcare system will soon fail, if nothing is done to make sure that everyone pays into the healthcare system.

First, it is necessary to understand that any type of insurance only works by spreading the cost of claims among a group which includes contributors who do not make claims. If all contributors of a group make equal claims, the cost of insurance will exceed the cost of claims. Insurance is sold by a profit-making company which has to cover the cost of claims; cost of administering claims; cost of overhead; commissions; salaries; pensions; and profit.

Second, it is necessary to understand the truth about the reasons for the increased cost of health coverage. Republican politicians like to blame the cost on medical malpractice, defensive medicine because of medical malpractice, and the cost of new and advanced medical equipment and testing. Doctors like to blame the cost on medical malpractice. The truth is that the cost of medical malpractice is barely measurable. While defensive medicine practices might be slightly measurable, it is not significant and would not go away if medical malpractice was ended. The real cost comes from three types of people: 1) Sick people who do not pay for medical insurance and receive medical treatment in hospital emergency rooms; 2) Healthy people who do not pay for medical insurance because they are healthy and would rather buy other things but will eventually one day end up receiving free medical treatment in the hospital emergency room (I know lots of these people); and 3) People from either of these groups who just cannot afford health insurance because they are not part of a group at work and individual coverage has already become unaffordable.

The Problem
As healthy people drop their health coverage because it’s too expensive, the cost of claims are spread among a smaller group of people who are still paying for the insurance because they are making claims. Eventually, premiums will equal the cost of medical care plus the cost of administering the health insurance and the profit earned by the health insurance companies.

As the cost of medical insurance increases as healthy people drop out, even people making claims will start dropping out as the cost of medical insurance becomes more than their claims.  I have seen this happen with United States Life Insurance Company when it wanted to get out of the group health insurance business. US Life started increasing premiums and companies started dropping the policies. My father’s company stuck with it for a long time because I have a sister with brain damage. Eventually, there were almost no groups left except those like ours and the premiums grew to more than the cost of medical care for my sister. My father dropped the insurance policy and Medicaid, funded by tax dollars, now takes care of my sister.

As I wrote in my previous article, my health insurance premium (single/individual non-group) was approximately $225 in 1998. By May 2001, my monthly health insurance premium with Empire Blue Cross Blue Shield was $337.65 per month. By April 2008, my monthly premium with Empire Blue Cross Blue Shield was $861.99 and in April 2009, my health insurance premium was increased by $215.79 per month to a total of $1,077.78 per month. The premium for 2012 is $1,520.45!

That’s a 575.55% increase in only 14 years. At that rate, the premium in 2026 will be $10,271.39 per month! The even bigger problem is that the increase accelerates as people drop out because they can no longer afford the premium or it no longer makes financial sense to pay it. At some point, almost no one can afford the health insurance premiums or if they can, it will cost more than directly paying for medical care so no one will have medical insurance.

The argument against the Individual Mandate, the most controversial part of Obama Care, is that the federal government should not be able to require individuals to purchase something they may not want to purchase.  One analogy was made with exercise.  Since exercise is known to be good for health, should the government be allowed to require everyone to exercise?  That justifies common sense and is now correctly being dealt with by health insurance companies offering rebates to people who prove they went to the gym.  As previously mentioned, governments require people to purchase insurance if they want to own or drive a car.  There should be no right to free health care.

The problem is that the United States is a great country which provides free medical coverage for people who do not have health insurance. If you do not have health insurance, you may not be able to see a private doctor but you can be treated by going to the emergency room at your local hospital. It has been reported that the cost of treating people without health insurance is currently adding $1,000 per year to the health insurance premium of people who are paying for health insurance. This amount will continue to increase as the cost of health insurance increases because people are no longer paying for health insurance.

If someone chooses not to purchase medical insurance, why should that person be entitled to free health coverage by going to the hospital emergency room for treatment?  Why shouldn’t people who choose not to purchase medical insurance be required to pay the $1,000 per year cost to everyone else?

I personally know a great many people, both friends and clients who can afford health insurance but choose not to pay for it. In fact, I know people living in expensive houses and driving expensive cars who do not have health insurance.

The implosion effect is snowballing rapidly. In the 1980s, I was licensed to sell health insurance and when I saw this occur with United States Life Insurance, I predicted that the entire health insurance system would fail within 20 years. I was way off with my prediction. It may just take another 20 years but it will happen sometime.

How can the health care system be saved if not everyone is required to pay for health insurance? The answer is simple. Do not require hospitals to treat people for free if they are not poor and require hospitals to maintain inexpensive clinics, with a lesser degree of care, for poor people. Just like driving a car, if you want to receive the best health care and you file a tax return, you should have to buy health insurance.

The Supreme Court should either allow President Obama’s health care reform (Obama Care) to stand or hospitals should not be required to treat people for free in their emergency rooms, forcing everyone else to pay for it.  The law will lower health insurance premiums for every individual and business who currently pays for health insurance.

A little about me: I am a registered Republican and a personal injury lawyer. I do not take medical malpractice cases and really couldn’t care if laws are passed to place caps on medical malpractice or even eliminate medical malpractice because I do not earn a living from that. However, to do so would be a travesty of justice for people hurt by medical malpractice; it would result in a lower quality of medical care; and wouldn’t save any money because someone has to pay for the cost. My sister has brain damage and received only a small amount of money from a medical malpractice insurance policy which was insufficient to pay for her care. Why Are We in Afghanistan?

With $100 billion being spent every year in Afghanistan, why are we there? In fact, why are we fighting anywhere? What has been accomplished in Afghanistan in the last 10 years? $1.2 trillion would have been better spent on defending our borders and the military. The money would have stayed in the US, boosted employment and helped to boost the economy. Of course, a lot of people would still be alive, suffering would be eliminated and trillions would not be needed for medical treatment and rehabilitation.

How can $100 billion per year cost the US trillions of dollars per year? The side benefits of a strong border defense are limitless and would save trillions more. A few of the very many benefits, other than preventing the importation of nuclear weapons or other weapons of mass destruction, include substantial reduction of transportation of illegal drugs; transportation of counterfeit goods across our borders; and transportation of unwanted animal life. Illegal drugs alone probably cost the US economy trillions of dollars. Counterfeit goods costs US jobs and loss of tax revenue. Unwanted foreign animal life is already threatening millions of dollars of damage to the US food supply.

Saving trillions more which was and is spent on other wars and continue to be spent in other countries (even South America), our defense will be stronger than ever, taxes will be reduced and the national debt will be eliminated.

Will NJ Governor Chris Christie Run for President?

I don’t think NJ Governor Chris Christie will run for President because he stated that he is not ready to be President of the United States and cannot see being ready in the foreseeable future.

If Governor Christie is somehow able to be ready to be President, he will have to explain how he became ready. At the least, he will have shown poor judgment in making a statement that his opposition will likely replay in TV commercials. The commercial will simply show the video clip of Governor Christie saying “I am not ready to be President of the United States and cannot see being ready in the foreseeable future.”

What should really be cut to balance the budget?

Who really wants to balance the budget, cut taxes or raise taxes, and/or cut or increase expenditures, the GOP, the Tea Party or the Democrats?

The GOP says they want to balance the budget, cut taxes and expenditures but it was the GOP which took a balanced budget created by President Clinton and ran it out of control with decreased taxes for the wealthy and the cost of the Afghanistan war and Iraq war. Decreased regulation allowed multiple economic catastrophes to occur.

President Obama allowed the federal deficit to balloon out of control in an effort to save the economy of this country and the rest of the world by saving some of the wealthiest US corporations. At the time it was being considered, several of my Republican friends said this had to be done. I was against it and thought that it would be better to allow some of these companies to go out of business.

Should taxes be raised to pay for two wars and conflicts in a dozen other countries which are never reported in the news? What about raising taxes for entitlements?

The GOP would like to cut taxes for the wealthy and cut entitlements which benefits people who are not wealthy. The GOP would even like to cut Social Security which they continuously refer to as an entitlement in a manner intended to be portrayed as a freebie.

Social Security and Medicare are not freebies, they are legitimate entitlements because they are just like a private annuity that we pay for. In fact, I pay a very substantial amount of Social Security taxes every year. Medicaid is the only entitlement that is a freebie but I don’t want to live in a country that does not provide medical care for people who cannot afford it.

So how can the federal budget deficit be eliminated and the budget balanced? A really good start would be to immediately discontinue all foreign military wars and conflicts. This would save trillions of dollars and allow more money to be spent on military defense. The Bush tax cut for the wealthy should be eliminated, at least temporarily, but not for people earning $250,000 per year and more but for people earning $750,000 per year and more.

Unfortunately, the GOP is allowing the Tea Party to dictate demands And thus preventing any compromise to raise the debt ceiling. If they are successful, they will change their opinions quickly when the Social Security checks for their parents stop coming and Medicare stops paying for their parent’s medical bills. Rather un-American, the Tea Party is not unlike myself. We both want to be dictators, we just have different ideas as to what to do.

Cut Medicare or Kill People, Which Is Better?

Congress wants to cut Medicare by $100 billion per year. This will affect people and children who will not be able to have access to adequate medical treatment. This is a good step to return America to the status of a Third World country!

On the other hand, killing people in Iraq, Afghanistan and a number of other Arab countries at a similar cost is a much better idea. In fact, this event has the benefit of causing serious injuries to Americans who are being shot and blown up and will need lifelong medical treatment. But they won’t have to worry because they receive medical treatment from the VA. But wait, the VA is underfunded and never seems to do what they should be doing. I wonder how many veterans are happy with the medical treatment they receive.

Congress also wants to cut Social Security or extend the year of eligibility because over many years they stole so much money out of Social Security for the general tax budget that there is no longer enough money left.

Somehow, Congress is always willing to go further into debt to start new wars.  It’s time we stop spending money to kill people in other countries and start spending money on American medical care, protection for our borders and defense.

More Animal Cruelty

Here is an article about YouTube banning a video of unbelievable animal cruelty involving the Texas E6 Cattle Company employees. Although you can see the video in that article, I read what the video depicts and have not been able to get the strength to watch it.

I do want to bring more attention to the article. I have an Uzi and would love to go hunting for employees at the E6 Cattle Company, but I would only aim for their arms, legs and groin. I at least hope that enough bad publicity might put them out of business and encourage other cattle companies to better supervise their employees, especially the budding serial killers.

Let’s Start More Wars and Cut Social Security!

The Republicans love to see America going to war and cut taxes, Social Security, Medicare and Medicaid. The Democrats are okay with America going to war and want to spend money on social services. But now, even the Democrats are talking about restructuring Social Security.

Taxes started with the American civil war and the tax code took off with World War II.  While these wars were worth fighting, the wars President Bush started in Afghanistan and Iraq were not worthwhile.  Afghanistan was a disaster for the Russians and should have been a lesson for us.  It would’ve been cheaper and easier to send them a few bombs.  Iraq was a stable country that could not threaten us.  Even President George H. W. Bush knew to stay out of Iraq.

Instead of starting a war in Afghanistan, President Bush should have spent the money on defense and development of weapons such as drones. After spending $1 trillion in Iraq, nothing has been done to protect American ports and borders.

Most people don’t realize it, but we have been spending money to fight a drug war in South America for many years. This money would be far better spent on protecting our borders. More recently, Mexico is becoming a major threat and violence has been crossing the border into America. Because the federal government doesn’t want to spend money protecting the border, homeowners have had to form civilian patrols. Unfortunately, they are ill-equipped and the violence is now extending far beyond the border into America.

Now, President Obama is spending more money on the civil war in Libya. President Obama may not want to call it a war but we are spending money to kill people and there is no other word for it. There is no doubt that this will spread to many other Arab countries and probably even Iran. What about Pakistan?

Not only has the Afghanistan and Iraq cost trillions of dollars but many Americans have been killed and even more Americans have been horribly disabled which also costs an enormous amount of money for medical treatment.

The only thing I never hear politicians talk about cutting is war. If the idiot politicians could stop starting one war after another, we could have spent a few trillion dollars on military readiness, defense, Social Security and have Medicare for everyone regardless of age. We should think defense instead of offense.
