The latest political insanity in New York makes possession of 8 rounds in a 10 round magazine, or having magazines with more than a 10 round capacity in New York will be defined as criminal possession of a weapon in the third degree which is a Class D Violent Felony.
Take a look at some class E felonies and A misdemeanors in New York which not as serious as a class D felony!
I haven’t seen the law but it sounds like I might be safe because my Walther PPKS only holds 7 rounds in the magazine and one in the chamber for a total of 8 rounds. The description at freepatriot.org only mentions the number of rounds in the magazine which would seem to exclude the one in the chamber. So, now I can shoot eight people in the head with one magazine (I can put all eight rounds in the black at 50 feet at the range) and reload a new magazine in approximately 1 second to kill another seven people. The magazines are so small but I can put several of them in my pockets. FreePatriot.org does not mention if the law prohibits carrying multiple magazines. If not, this is a major oversight of uneducated politicians.
This is what happens when politicians who don’t carry guns in a stupid laws which hurt law-abiding citizens and will do nothing to reduce crime or a tragic deaths of teenagers shot with illegal handguns. Unfortunately, gang members won’t care about carrying an illegal gun with a large capacity magazine and even if a gang member did care, it wouldn’t stop him or her from firing 7 or 8 bullets and indiscriminately killing a few children who happened to be in the wrong place because gang members don’t know how to shoot straight.
It’s time to stop passing ridiculous laws and do something to get illegal guns off the streets. Unfortunately, the police department’s stop and frisk policy was ruled unconstitutional but it could probably still be accomplished with some minor modifications such as stopping and frisking people for spitting on the street. New York City has one year mandatory jail time for possession of an illegal gun but I doubt that there is anyone in jail.
Some interesting gun facts:
- 30 cal. M1 is ok under proposed gun laws because it doesn’t have a pistol grip, yet it’s more dangerous than an AR15
- An Uzi fires a 9mm pistol round – but it looks nasty.
- 4 million AR15 are already owned.
- 8,583 people killed with firearms in 2012 but only 323 were killed with all types of rifles only some of which were “assault style” rifles.
- The real problem with the AR15 is the small caliber high velocity .223 bullet which causes major injuries. If it were made in a .22 short or BB, politicians would still want to ban it because it looks scary.
- 3d printing at home will let people make any gun they want. Laws will only stop law abiding citizens and a small number of crazy people. The answer is to keep all guns out of the hands of the emotionally disturbed.
What needs to be done to get illegal handguns off the streets:
- Continue strict enforcement of minor crimes, started by Mayor Giuliani.
- Strict enforcement of mandatory jail time for possession of illegal guns.
- Substantially increase jail time for crimes committed with an illegal handgun and make it mandatory.
- Mandatory education and vocational training for anyone convicted of a crime who doesn’t have a high school diploma.
- A national gun-control law requiring a background check when any type of gun is purchased to be paid by the purchaser. A background check should be good for purchases in the following 36 months and should include a visit with a psychologist. I would be willing to pay the full cost for the privilege of owning a gun and the knowledge that I would be helping to prevent a tragedy.
- A national gun-control law restricting sales of guns to residents outside the state of sale, except if done through a gun dealer in the state of sale and shipped to a gun dealer in the state of the purchaser.
- Enacting a federal law prohibiting by the media to mention the assailant’s name after a mass shooting, thus denying the notoriety so desperately sought by a few crazy people.
The NRA needs new leadership which can negotiate with politicians to protect gun owner’s rights and protect innocent victims at the same time!
